Jem Aswad Executive Editor, Music Ex-Red Hot Chili Peppers guitarist Josh Klinghoffer was sued for wrongful death Wednesday for allegedly running over and killing a pedestrian in Los Angeles.

According to the lawsuit, which was accompanied by video and still photography of the accident from the suing attorneys, Klinghoffer was allegedly on his phone while making a left turn and striking Israel Sanchez, 47, causing blunt-force trauma to the head.

A photograph taken from the video seems to show that the driver is holding a cell phone, although it is unclear; Sanchez died of his injuries hours later.

The lawsuit states that no arrest was made in the incident. While identifying information is unclear in the video, Klinghoffer’s attorney, Andrew Brettler, told TMZ, “It was a tragic accident.
