Dunipace man left threatening and abusive voicemails on his ex-partner's phone

A Dunipace man with a history of domestic abuse who left threatening voicemails on his ex’s phone was this week jailed for six months.Kevin Malloy, or Modica, of Milton Place, had admitted a charge of engaging in a course of behaviour abusive of a partner or ex-partner contrary to the Domestic Abuse (Scotland) Act 2018.The 37-year-old had committed the offence between April 2022, when the relationship between Malloy and the woman had come to an end.The fiscal depute told Stirling Sheriff Court on Wednesday that the complainer, who recognised Malloy’s voice, had received numerous phone calls and voicemails of an abusive and threatening nature.Malloy’s agent recognised that a custodial sentence would be at the forefront of Sheriff Derek Hamilton’s mind.He pointed out that Malloy was due to undergo hip surgery - and any jail sentence would put that back for “a considerable amount of time”.The solicitor asked Sheriff Hamilton to give Malloy “one final opportunity” by imposing a community-based order with reviews “to keep an eye on him”.

And, if an outstanding court matter “goes wrong”, a custodial sentence would be inevitable.Sheriff Hamilton however told Malloy that he had abused women since 2010 and this was one of a handful of convictions for domestically-aggravated offending.
