Prison living cost deductions from wrongful conviction payments scrapped after Andrew Malkinson case

Wrongly convicted people will no longer face having living costs covering their time in prison docked from compensation payments after ministers issued fresh guidance, it was confirmed today.

It follows an outcry after the case of Andrew Malkinson - jailed for a crime he did not commit. After his conviction was quashed, he revealed he may have to pay thousands of pounds to the prison service for 'board and lodgings' over the years.

Mr Malkinson had his 2004 conviction for a brutal rape in Salford quashed by Court of Appeal judges, but it took him 20 years to clear his name and he spent 17 years in jail. He was 37 when he was found guilty on February 10, 2004, by a 10-2 majority of carrying out a violent sex attack on a mum-of-two by the M61 motorway in Little Hulton.

He was jailed for life with a minimum term of seven years and remained in prison for a further 10 because he maintained he was innocent.
