Shadow home secretary says Andrew Malkinson shouldn't be ‘penalised any further’ amid reports he could be forced to pay prison service

Shadow home secretary Yvette Cooper has said she does not believe it would be appropriate for Andrew Malkinson to be ‘penalised any further’ following reports his jail living costs may be deducted from any possible compensation.

Mr Malkinson, 57, spent 17 years behind bars for a rape that he didn't commit. He had always denied carrying out the violent attack on a woman by the M61 motorway in Little Hulton in July 2003.

He was jailed for life with a minimum term of seven years but remained in prison for a further 10 because he maintained he was innocent.

His conviction was quashed by senior judges at the Court of Appeal on Wednesday after DNA evidence linked another man to the crime. Following the decision, it was widely reported that he may be required to pay for the cost of food and accommodation covering his time spent in jail.
