Last year the Supreme Court of Appeal upheld an appeal by Jon Qwelane and declared sections of the Equality Act unconstitutional.
Qwelane had written a homophobic column in the Sunday Sun and a high court had found it to be in breach of the Equality Act.
The Constitutional Court will hear an appeal against the judgment next week. Civil society organisations have made court submissions on both sides of the debate.
