President Trump announced Monday that he was deploying the D.C. National Guard and vowed to mobilize the military to put an end to the protests around the country following the death of George Floyd, something he can do under the Insurrection Act of 1807.
The Insurrection Act of 1807 serves is an exception to the Posse Comitatus Act, which prohibits the president from deploying the military in domestic law enforcement situations.
Trump did not mention the Insurrection Act of 1807 specifically in his Rose Garden speech, but did say, “If a city or states refuses to take the actions that are necessary to defend the life and property of their residents, then I will deploy the United States military and quickly solve the problem for them.” The
