Scot who killed OAP after crashing into her with his car and throwing her into the air dodges jail

A pensioner who caused the death of another OAP by mowing her and her friend down while they were out walking has been spared jail.

John Macdonald could have been caged for striking Jean Malcolmson and Mary Weir as they crossed the street. He struck them with such force the pensioners were thrown up in the air, landing a car length away from each other.Macdonald, 81, didn't brake until after hitting the friends, but got out of his car and rushed to their aid.He was unaware Mrs Malcolmson, 73, had suffered brain injuries so bad she would die a few days later in hospital.

Macdonald returned to the dock at Paisley Sheriff Court yesterday to be sentenced, after admitting his guilt over her death last month.

Sheriff Brian Mohan fined him £2,000, reduced from £3,000, and ordered him to pay the fine within 28 days.He also banned Macdonald, who had surrendered his driving licence after the crash, from driving for three years.Macdonald had pleaded guilty to a charge of causing death by driving "without due care and attention", in breach of Section 2B of the Road Traffic Act 1988.Prosecutor Harry Findlay previously told the court the incident took place on October 29 last year in Walkinshaw Street, Johnstone.He said the collision, at the junction with the Renfrewshire town's High Street, took place at 11.34am and left the women "more than a car length apart".He added: "The accused didn't brake until after the collision."Mary Weir was able to get up onto her feet."Mrs Malcolmson's head was on the area of the kerb and her torso and legs were on the roadway."She had multiple head, body and leg injuries.
