Miley Cyrus has settled a legal dispute with photographer Robert Barbera, who accused the musician of copyright infringement by posting a photo he had taken of her onto Instagram.It was by no means the first lawsuit filed over a celebrity posting a photo taken by a paparazzo to their personal social media profiles without permission. Indeed, it was by no means the first lawsuit of this kind filed by Barbera, who has previously sued the likes of Justin Bieber, Ariana Grande and Dua Lipa.The copyright in a photo, of course, belongs by default to the photographer not the person who appears in the image.

He claims that the image she posted on her Instagram in February 2021 was done so without his permission.Bloomberg Law reports that Barbera’s complaint alleges that Cyrus received a financial benefit from her infringing post, which boosted traffic to her account and increased revenue generated by the sale of her music.Barbera claims that Cyrus’ “impermissible use has crippled if not destroyed the potentiality of any market for the Photograph”.The photographer is seeking a jury trial as well as actual and statutory damages.Meanwhile, earlier this year Barbera sued Dua Lipa for a second time for sharing one of his paparazzi photos of herself on Instagram.Barbera is reportedly seeking damages and penalties from the profits Lipa could have made with the photograph on Instagram, on which she advertises her music, brand and business interests.He also claims that he attempted to settle the matter with Lipa outside of court.

Dua Lipa is facing a second civil lawsuit over the alleged sharing of a paparazzi picture of herself on Instagram.The lawsuit was filed on June 20 in California by New York-based photographer Robert Barbera, Billboard reports. The photographer alleges that Dua Lipa has infringed his copyright by posting photos that he snapped of her in July 2018 to Instagram.The alleged photo – which can no longer be found on the singer’s social media profile – is said to depict the artist sporting a black sweater with the words “HEROES” printed on it.An excerpt of the complaint obtained by Billboard claims: “Without permission or authorization from Plaintiff, Defendant volitionally selected, copied, stored and displayed each of Plaintiff’s copyright protected Photographs.”Barbera is reportedly seeking damages and penalties from the profits Lipa could have made with the photograph on Instagram, on which she advertises her music, brand and business interests.Barbera also claims that he attempted to settle the matter with Lipa outside of court.
